Executive holidays extended

Federal Law of July 20, 2020 N 215-FZ establishes the specifics of the compulsory execution of judicial acts, acts of other bodies and officials, as well as the return of overdue debts during the spread of a new coronavirus infection. In particular, the aforementioned law in relation to pensioners, as well as small and medium-sized businesses employed in the industries most affected by the pandemic, provides for an installment plan for the payment of debt according to the submitted executive documents (the so-called "executive holidays"). The installment plan is provided once, the debt must be repaid in monthly equal payments (for more information about the essence of executive holidays, the conditions and procedure for obtaining them for citizens and businesses, see our materials - a special review and news).

Now, such an installment plan can be obtained according to executive documents, which will be presented for compulsory execution until 05/01/2021 (and not until October 1, 2020, as previously stipulated). The corresponding amendments to Law No. 215-FZ entered into force last week (12/22/2020).

In addition, until July 1, 2021 (previously the deadline was 12/31/2020 inclusive), the period during which the bailiff-executor does not apply compulsory enforcement measures related to the arrest and seizure of movable property against all debtor citizens, has been extended. excluding vehicles. Recall that this restriction does not apply to the execution of a judicial act on the seizure of the debtor's property.
