St. Petersburg City Court charged more than 500 thousand rubles from the company, because she did not give the former employee a work record in time.
The court did not require from the employee evidence that he could not get a job because of the lack of employment record. It is enough the organization’s fault that it did not issue the book on time.
Note that in earlier practice, the St. Petersburg City Court supported the decision of the first instance, which took a different position. For compensation, the former employee had to confirm that he was trying to find a job, but was refused due to the lack of a work record.
So that you do not have to pay compensation to the dismissed employee, hand in the employment record on the day of termination of the employment contract. If you don’t get your hands on it, send a notification about the need to pick it up.
